Gamers DB Terms of Use
By installing or using the Gamers DB Desktop Parser ("the Software") or the Gamers DB website ("the Site"), you agree to these Terms. If you don't agree, don't install or use them.
1. Who we are
The Software and Site are operated by [LEGAL NAME OF THE PERSON OR COMPANY OPERATING GAMERS DB] ("we", "us"). Contact: [PRIVACY CONTACT EMAIL]. Our Privacy Policy explains how we handle personal data and forms part of these Terms.
2. Not affiliated with game publishers
Gamers DB is an independent fan project. It is not affiliated with, endorsed by, or sponsored by Daybreak Game Company, Darkpaw Games, Sony, or any other game publisher. All game names, content, and trademarks belong to their owners.
3. Your responsibility for game rules
The Software reads information from your computer while a game is running, including the game's log files and, for some features, the game's memory. You are solely responsible for making sure your use complies with the game's terms of service, EULA, and any server rules. A publisher or server operator may take action against your game account, and we don't control or guarantee their decisions. Use features that read game memory at your own risk. Don't use the Software to gain an unfair advantage, to automate gameplay, or to harm other players.
4. Your account and who may use the Service
You must provide accurate information and keep your sign-in credentials secure. You're responsible for activity on your account.
You must be at least 13 years old, or the minimum age of digital consent in your country if it is higher (up to 16), to create an account. If you are under the age of majority where you live, you may only use the Software and Site with the permission of a parent or guardian, who is responsible for what you do with them. Browsing the public game databases does not need an account.
When you create an account you confirm that you meet this requirement. We don't ask for a birthdate or an ID, so we rely on that statement. If we learn that an account belongs to someone below the minimum age, we remove the account and the data attached to it (see Section 8). 5. What you may do
You may install and use the Software for personal, non-commercial purposes. You may not:
- reverse engineer, decompile, or modify the Software, except where the law allows despite this restriction;
- redistribute the Software or offer it as a service;
- attempt to bypass permission checks, access other users' data, or probe or disrupt our servers;
- upload data you know to be false, or submit fabricated data to catalogs or collectors;
- harass, threaten, or expose other people through the Site or the data you submit;
- use the Software or Site unlawfully.
6. Data you sync or contribute
Some features upload data to the Site: character stats, inventory, spells, guilds, parses, and (if you use the collector features) item, recipe, vendor, and NPC observations. What is visible to whom is described in the Privacy Policy and in the feature's settings; in particular, character data you sync is shown publicly, so don't sync a character you don't want shown. Sync is initiated or enabled by you and you can stop it at any time.
You keep ownership of your own content. You grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and combine it, including in aggregated form (such as rankings and shared game catalogs), to operate and improve the Site. Observations about game content, such as item stats, are game facts and may remain in shared catalogs after you leave. Don't upload anything you don't have the right to share.
7. Updates
The Software may check for and install updates. Updates may change or remove features. We may change or discontinue the Software or Site at any time.
8. Suspension and termination
We may suspend or end your access if you breach these Terms, abuse the service, or create legal or security risk, and we remove accounts that belong to someone below the minimum age described in Section 4. You may stop using the Software at any time and may delete your account yourself from Profile > Security, or ask us to delete it as described in the Privacy Policy.
9. Disclaimer of warranties
THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. We don't warrant that the Software or Site will be accurate, uninterrupted, or error-free, or that displayed game data or calculations match the game.
10. Limitation of liability
IN NO EVENT SHALL THE COPYRIGHT OWNER OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. This includes any action a game publisher takes against your game account. Where the law doesn't allow these limits, they apply to the fullest extent permitted.
11. Changes to these Terms
We may update these Terms. When we do, we'll change the version above. The Software will ask you to accept the new version the next time you sign in to it, and if you don't accept, you must stop using the Software. On the Site, continuing to use it after a change takes effect means you accept the updated Terms.
12. Record of acceptance
When you accept, we record your account, the Terms version, the date and time, where you accepted (creating an account or signing in to the Software), and the Software version, so we can show which Terms you agreed to. This record is deleted with your account.
13. General
These Terms are governed by the laws of [JURISDICTION], and disputes go to the courts of [VENUE], unless your local law requires otherwise. If part of these Terms is unenforceable, the rest stays in force. These Terms and the Privacy Policy are the whole agreement between you and us about the Software and Site.
